NOTICE OF SALE C/A 2019-CP-28-00554 BY VIRTUE OF A DECREE of the Court of Common Pleas for Kershaw County, South Carolina heretofore issued in the case of Southern Gaines, LLC, Plaintiff vs. Danny S. Hensley and Chrissy L. Hensley, Defendants, I, the undersigned Master-in-Equity for Kershaw County, will sell on December 2, 2019, at 12:00 noon, at the Kershaw County Courthouse in Camden, South Carolina, to the highest bidder. LEGAL DESCRIPTION All that certain piece, parcel, or tract of land, with improvements thereon, situate, lying and being nine (9) miles NE of Camden, Kershaw County, State of South Carolina, delineated as Lot 3 containing 5.374 acres, more or less, as shown on that certain plat prepared by Franklin D. Cooper, Jr., RLS/PE dated March 15, 2003 and recorded January 30, 2006 in the office of the Register of Deeds for Kershaw County in Volume B170 at Page 2B. This is a portion of the property known as Lockhart Road. This being a portion of the property conveyed unto Southern Gaines, LLVC, by deed of Carolina Land Funds, LLC, executed February 13, 2006 and recorded February 20, 2006, in Book 1919 at page 199 in the office of the Register of Deeds for Kershaw County, South Carolina. Property is subject to all matters of survey and any and all recorded or unrecorded conditions, restrictions, easements, zoning ordinances, and/or rights-of way including but not limited to those Restrictive Covenants recorded in Book 1321 at page 77 and Amended in Book 1326 at page 199 that may have been reinstated by deed recorded in Book 1919 at page 199 in the office of the Register of Deeds for Kershaw County. This conveyance is subject to all visible and/or recorded easements, restrictions, covenants, rights-of-way and zoning ordinances which affect said property. TAX MAP NUMBER: TERMS OF SALE: For cash. Interest at the rate of eleven (11%) per cent annum to be paid on balance of bid from date of sale to date of compliance. The purchaser to pay for preparation of Deed and stamps and that the successful bidder or bidders, other than the Plaintiff therein, do, upon the acceptance of his or her bid, deposit with the Master-in-Equity for Kershaw County a certified check or cash in the amount equal to five (5%) per cent of the amount of bid on said premises at the sale as evidence of good faith in bidding, and subject to any resale of said premises under Order of this Court; and in the event the said purchaser or purchasers fail to comply with the terms of sale within twenty (20) days, the Master-in-Equity shall forthwith resell the said property, after due notice and advertisement, and shall continue to sell the same each subsequent sales day until a purchaser, who shall comply with the terms of sale, shall be obtained, such sales to be made at the risk of the former purchaser. Since a personal or deficiency judgment is waived, the bidding will not remain open but compliance with the bid may be made immediately. If the Plaintiff or the Plaintiff's representative does not appear at the above described sale, then the sale of the property, will be null, void and of no force and effect. In such event, the sale will be rescheduled for the next available sales day. The Plaintiff may waive any of its rights, including its right to a deficiency judgment prior to the sale/ Sold subject to taxes and assessments, existing easements and restrictions of record.
